After three meetings of the team and after a period of four days, she was transferred to rehabilitation center as the professional thought it would benefit her properly. Not much information is present in the case study regarding the activities that had been conducted by the team in the neurology wards. The team in this ward contained of different professional who should have at least diagnosed her symptoms for seven days to monitor whether any negative conditions in her head or in her health had occurred or not (AlSayah et al., 2014). It seemed that they hurriedly transferred her to the rehabilitation centre. They mainly conducted a transitional mode of care where they transferred the patient to the rehab care. From the hospital course shown, it is seen that follow up is done for loss of balance, coordination and difficulty in ambulation but proper procedures have not been followed as is evident from case study. Secondly, in the rehab centre, it was seen that the multidisciplinary team consisted of physiotherapist, occupational therapist, rehabilitation medical consultant, and the nursing staff. They had been assessing her condition on a daily basis and therapy for assistance in coordination and walking went for six days (Gausvik et al., 2015). They were following a model of shared care programs where they were writing notes about jenny in the medical record to inform each other about the updates of Jennys case. However the procedure was not a proper one as it indirectly affected her health. As one member of the team took a wrong observation by stating that she has been walking with confidence just from one observation, she had noted the information without taking other observations. This was a mistake from her part as this went on to several errors (Rodrigues et a l., 2014). The rehab consultant as well as the physiotherapist without conducting their respective assessment discharged her which is not ethically and intellectually correct. All of them have confirmed about the assessment individually before proposing for discharge, a proper training is required by the team in order to strengthen their critically analysing power so that each of them conduct their assessments properly to provide higher patient safety. They also did not educate her about the diabetes management and neither evaluated her present condition, as a result she went through another episode of insulin shock that results in further harmful consequences (Klipfel et al., 2014). The decisions made by the first multidisciplinary team were found to be quite rapid as they did not evaluate the patients condition fully before transferring her to the rehabilitation centre. They had not conducted their work responsibly which is evident from the transition of the patient to the rehab centre. However, it is true that they had diagnosed the symptoms correctly and had allotted a multidisciplinary team with the right specialists for her different symptoms. She had faced injury in her head region for which she was having consistent headache, loss of coordination as well as difficulty with walking (Lancaster et al., 2015). These were noted by the professional clearly and therefore they had conducted diagnostic tests of her head region to find out whether she had faced major accident in her brain. They had conducted CAT scan and found out that no issue is present in her brain or skull region. This was an important diagnostic step and they rightly carried out the second poi nt of the clinical reasoning cycle called the gathering information stage. This has been negligence on their part and they are therefore accountable for the occurrence that Jenny again had due to insulin shock. It was seen that the multi-disciplinary team of the hospital communicated over three meetings where they sat together and decided the course of treatment for the patient. It is the right kind of communication as this gives the scope of every specialist to put in their updates in front of all the team members where they can either use the information for their own interventions or they can also inform the others about better suggestions or others. However in the later case, it was not followed. The multi disciplinary team had an improper way of communication. They used to note down the changing symptoms of the patient and jot them individually so that others can see. This form of communication may prove to be harmful for the patient as if a particular professional makes a wrong evaluation; it will lead to several other chains of errors as others will act upon the observation made by the former (Victor-Shmil, 2013). These may be harmful for the patient safety as it happened in case of Jenny. When the nurse informed about the patient walking confidently, all others acted upon the documentation made by her. Moreover, it was also seen that all the professionals did not perform their individual evaluation before discharging the patient and depended upon the nurse entirely. This should not have been the procedure. Before discharge, all the team members should have evaluated her symptoms and jointly come to a conclusion by face to face meetings (Keleher et al., 2017). She should also appoint a social care who would be assisting her with the daily activities. The judgements of Salmon LJ and Fenton Atkinson LJ, although reaching the same conclusion have very different reasoning. Salmon LJ considered that two main factors needed to be addressed; whether or not the parties had intended a legally binding contract, and whether the terms of the contract were sufficient to be legally enforceable. The English law operates generally on an objective approach based on what a reasonable person in the position of the parties would have intended. Salmon LJ follows this approach in his judgement, stating it is a presumption of fact that when arrangements are made between family members, they are not intended to create a legal relationship but are rather based on mutual ties of trust and affection. This presumption was established by Atkins LJ in his explanation of the case Balfour v Balfour and is cited by Salmon LJ, however he does go on to accept that in some circumstances just because a, Contracting party is unlikely to extend his pound of flesh does not mean he has no legal right to. I consider that the principle illustrated by Balfour v Balfour, although fundamental for many cases, may not be so relevant considering the circumstances of this case. In a society of increased domestic disruption, illustrated through statistics such as rising divorce rates, it is very arguable that family arrangements are becoming more likely to be intended as legally enforceable. In considering the very special circumstances of this case, I consider it is possible to distinguish it from that of Balfour v Balfour and rather follow the approach of Fenton Atkinson LJ, studying the specific intention of the parties rather than the presumption derived from the case of Balfour v Balfour. Salmon LJ considers the second factor to be addressed is whether the terms of the agreement were sufficient enough to be legally enforceable. He considers the intentions of the daughter were clear- to leave Washington and study for the Bar in England, but did not consider the mother would have intended to give up all her rights concerning the house. The arrangements were too vague to have contractual intent. Similarly there is no evidence that the mother ever intended her daughter to receive any more than $200 in West-Indian terms, a month maintenance support. On this point I agree with Salmon. In English law, if the terms of an offer are not certain, the resulting agreement can fail. I do not consider that the terms were certain enough to ensure a legally binding contract, and here agree with the explanation from Fenton Atkinson LJ, that the responsibility was for the daughter to establish a contract in relation to the house and she totally failed to do so. Salmon LJ considered alongside this, that the terns of the offer could not possibly exceed five years from 1962 considering all circumstances of the case, and thus the daughter was entitled to nothing further under the original agreement Salmon LJ concluded his judgement by addressing the counterclaim referred to by the CCJ, and states that a reasonable compromise should be reached on the figures, so as not to exacerbate ill feeling between parties. This view in considered too by Fenton Atkinson LJ. Fenton Atkinson LJ addresses the issues of consideration and intention in his judgement; issues which I have to consider are far more relevant to the specifics of this case. He addresses several points in his judgement, firstly whether the agreements made between the parties were intended to be legally enforceable, secondly did the mother intend to be legally bound to support her daughter for an uncertain period of time, and thirdly did the daughter assume a contractual obligation to complete her studies. Fenton Atkinson LJ concludes that consideration was given by the daughter in the form of executed consideration, evident through her move from Washington to London, but does not consider that here consideration can determine whether the parties intended a legally binding contract. The courts generally apply an objective approach when studying intention, however I agree with Collins, who states that this objective approach conflicts with reality. Fenton Atkinson LJ, following this approach, states that it is the history of this case which most accurately points to the intentions of the parties, and highlights three important factors. Firstly, that the payments of $200 were accepted by the daughter without any indication that the mother was contractually bound to a larger sum, secondly, that when in 1964 The mother bought the property, many matters had been left open, such as the control of rents, and occupation boundaries. The final factor highlighted, and which I consider to be of huge significance, is the behaviour of the daughter when her mother visited. The daughter was evidently extremely upset that the issue had become litigated, and stated that a mother does not normally sue her daughter. This is perhaps the strongest indication that the daughter had never intended legal consequences to arise from the agreement. Fenton Atkinson LJ was satisfied that no legally binding contract had been intended, and the arrangements had been based on mutual trust. He held that the mothers claim for possession should succeed, and the appeal allowed. Although Salmon LJ and Fenton Atkinson LJ reached the same final judgement, I do not consider that the reasoning of Salmon was as relevant to this case as that of Fenton Atkinson LJ. As I have mentioned above, the objective approach applied by Salmon LJ cannot be applied in every case and may in fact be becoming outdated. The approach adopted by Fenton Atkinson LJ must be considered more appropriate for the very special circumstances of this case, and I agree that the intention of the parties was best determined through the behavioural history of the mother and her daughter rather than the judgement of Balfour v Balfour. I do not deny that the reasoning of Salmon LJ is that which the majority would be likely to adopt, and agree with many other factors he addresses, such as the judgement of reasonable time not exceeding five years. I cannot however conclude that his reasoning is of such relevance to this case, as that of Fenton Atkinson LJ.

But, black gospel music had only a very limited effect on popular styles, until a few church-trained artists, such as Sam Cooke and Ray Charles, began to incorporate gospel styling into their popular work. The result is usually described as â€Å"soul music,† a mix of blues, rhythm and blues, and gospel voices. But, if Ray Charles was one of the â€Å"originators† of soul music, â€Å"Aretha Franklin reshaped it,† by bringing even more of her gospel background to bear on secular love songs (Wade and Picardie 27). By combining popular elements with her stunning voice, her great musicianship, and the feeling for a song that she learned in church, Aretha became one of the greatest soul singers to ever live. Aretha Franklin is a well-known pop, R&B, and gospel singer. She has been nicknamed â€Å"The Queen of Soul† and is an internationally known artist and a symbol of pride in the African American community. After a couple of years he attended LeMoyne College, and he studied Education and English Literature. With his education he was able to bring a more liberal view to his preaching’s. Then he moved the family to Buffalo, New York. When he had the resources, he moved the family again to Detroit, Michigan were he settled and became a pastor of a churched called New Bethel Baptist Church. He quickly became one of the most famous pastors in the city of Detroit. Aretha was two years old when they made their final move, she would grow up here and grab the emotion of Church and incorporate it into her music. Aretha Franklin’s mom, Barbara V. Skaggers, served as choir director and pianist. Aretha describes her mom as â€Å"a Superb singer, her voice was clear and distinctive†. (Franklin and Ritz, 6) Her parents taught her how to sing with great pride. This was a big issue because the late ‘50s, early ‘60s was a time of turmoil for African Americans. Her father especially tried to instill pride into her. He was a Civil Rights activist and he was a close colleague with Dr. Martin Luther King. With her parents keeping her involved in Church she was bound to become one of the world’s greatest singers. At around age 12, the father recognized Aretha’s talent as a singer. So he took her on the road with his traveling gospel show. This was important because it shows the kind of support Aretha received from her family. It was said, â€Å"She was a spellbinding performer at the age of fourteen. † (Franklin, 3) So her family really supported and inspired her to become a gospel singer. What also made her a great artist was that she had inspiring people all around her. Aretha grew up in Detroit which at the time was a rousing city or a city of hope for the African Americans running away from the brutality of the South. Though Detroit still had its problems such as race riots, many famous musicians grew up there. Also since New Bethel Baptist Church was so prominent, many musicians and political leaders used Reverend Franklin’s pulpit as a platform to sing or speak to the Black’s of Detroit. Aretha was introduced to classical music by Smokey Robinson’s sister Sylvia Burston. She listened to well known local DJ’s like Ruth Brown and Senator Brystal Brown. When Aretha was younger, she would ride her bike to the local park, and on her way home she would stop by a night club where you could here B. B. King perform. She says, â€Å"You could hear the soft sound of his guitar all the way to the sidewalk (Franklin and Ritz, 22). National and local political leaders would give there speeches. Speakers such as Dr. Adam Clayton Powell, Sr. , Dr. Martin Luther King, and Reverend Jesse Jackson would speak powerfully to the church. Aretha was directly influenced by Miriam Anderson, Sammy Davis, and Roy Wilkins. Detroit was overflowing with talent and speakers which I believe also contributed to Aretha’s success. Pain was probably what really drove Aretha Franklin’s success. As stated before, Franklin’s family was highly religious and was continually involved in the Church. But that doesn’t mean that she hadn’t been through a tremendous amount of pain. Early in life her mother and father got a divorce. The father was better suitable to raise Aretha and her four Siblings. The mother moved to Buffalo, New York and tried to make regular visits to see her children. She was supported her children in the best way she could, but when Aretha needed her, she still was not reachable. Matters became worst a few years later when Aretha’s mom dies of a stroke. Aretha described her mom by saying â€Å"she was the absolute lady† (Smith, 3). At age 15 she had her first child and two years later another would come. But Aretha still wanted to go out and be with friends, so her grandmother usually babysat for her periodically. In a time when Black Activism, Feminism, and Sexual Liberation were high, she needed to provide for herself. So when Aretha was old enough and was ready to start performing, she hired a man named Ted White to be her manager. He later became her husband. In the future she would divorce him for a famous actor which would end in divorce, too. Even though in 1968 to 1969, Franklin’s career was rising rapidly. She was still described by her Producer Jerry Wexler as â€Å"a person whose depressions runs deeper than the sea† (Ritchie Unterberger, 3). Then one of Franklin’s highest admirers, gospel giant Mahalia Jackson died. Right after her death a extremely emotional gospel album was released my Aretha â€Å"Amazing Grace† This record was considered to be one of the most emotional records of its time. Much of the pain that Aretha suffered was not really publicized, but still it had to be one of the reasons for her to have such a powerful voice. Aretha Franklin was a successful artist and still inspires musicians today. Her voice is still described as incredible. She has all the awards that she needs to show her talent.
